THE JONES ACT 

The Merchant Marine Act of 1920 – known as the Jones Act - is a United States Federal statute that is specifically responsible for regulating maritime commerce both within U.S. waters and between U.S. ports.

Importantly, it is a cabotage law that contains certain, key provisions regarding the rights and the protection of seamen. 

The Jones Act allows sailors injured in accidents at sea to secure financial damages and compensation from their employers for the negligence of the ship-owner, the captain of the ship, and/or their fellow crew-members.  

Its particular and relevant provision can be found at 46 U.S.C. § 688(a), which states: "Any sailor who shall suffer personal injury in the course of his employment may, at his election, maintain an action for damages at law, with the right to trial by jury, and in such action all statutes of the United States modifying or extending the common-law right or remedy in cases of personal injury to railway employees shall apply.”
