LARGE TRUCK ACCIDENTS, INJURIES & DEATHS *** Attention *** If you were potentially seriously injured as a result of a large truck accident, or you have a loved one who was injured or even died following a large truck accident, please contact us immediately for a FREE potential case evaluation. Every year thousands of U.S. citizens are seriously injured or killed as a result of large truck accidents. For example, in 2007, the overall statistics were as follows: Deaths in accidents involving large trucks: 4,808 Non-fatal accidents involving large trucks: 139,587 Injury crashes involving large trucks: 56,487 Large trucks involved in tow-away crashes: 83,100
In 2006, the Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA) published an extensive report titled The Large Truck Crash Causation Study (LTCCS). The purpose of the study was to examine the underlying causes behind serious crashes involving large trucks (which are specifically designated as trucks with a gross vehicle weight rating over 10,000 pounds). From the approximately 120,000 large truck crashes that occurred between April 2001 and December 2003, a nationally-representative sample was carefully selected. Each crash in the LTCCS sample involved at least one or more large truck and resulted in an injury or a death. The LTCCS sample of 967 crashes involved a total of 1,127 large trucks. Of the 967 crashes in the sample, 73 per cent involved a large truck colliding with at least one other vehicle. The top 10 causes of accidents involving large trucks were: Problems with the vehicle’s brake-systems Traffic flow interruption and congestion Prescription drug use Traveling too fast for the conditions Unfamiliarity with the relevant roadway Roadway problems Failing to stop at traffic control devices, such as crosswalks Over-the-counter drug use A lack of proper attention Tiredness
All of these factors have resulted in tragic deaths, serious injuries, and misery for the victims of such accidents, as well as for their families. In a case involving personal injury or death, the person who initiates the action – the plaintiff – has to demonstrate that either the trucking company or the driver showed evidence of negligence, and that they did not demonstrate or execute what could be considered a reasonable standard of care. The criteria for such evidence can include: A truck that was incorrectly loaded or a truck that was overloaded to the extent that it was in violation of federal trucking safety rules A truck-driver who drove his or her vehicle in a reckless fashion A truck that, as a result of inaction on the part of either the company or the driver, was not properly maintained in accordance with required safety regulations A truck-driver who has been adversely affected by drugs (prescription, over-the-counter, or illegal); alcohol; and/or tiredness A truck-driver or company that fails to comply with federal trucking regulations in general
